If approved, the school operated by the Archdiocese of Oklahoma City would swing open the door for tax-payer funded, religious instruction at other charter schools.\u00a0<\/p>\n\n\n\n<p>But first, Oklahoma\u2019s Statewide Virtual Charter School Board needs enough members to meet, something it hasn\u2019t done since November.&nbsp;<\/p>\n\n\n\n<p>The board is down to two people \u2014&nbsp;not enough to conduct business. They are waiting on appointments from Gov. Kevin Stitt and state legislative leaders.<\/p>\n\n\n\n<p>By statute, the board consists of one member from each of Oklahoma\u2019s five congressional districts. The governor appoints the fifth district member. Senate Pro Tempore Greg Treat, R-Edmond, appoints for the first and third; House Speaker Charles McCall, R-Atoka, the second and fourth.<\/p>\n\n\n\n<p>There are three vacancies. In November, Brandon Tatum resigned as the board\u2019s 5th district representative after being <a href=\"https:\/\/oklahoma.gov\/governor\/newsroom\/newsroom\/2022\/november2022\/governor-kevin-stitt-announces-dr--brandon-tatum-as-chief-of-sta.html#:~:text=Brandon%20Tatum%20will%20serve%20as,team%2C%E2%80%9D%20said%20Governor%20Stitt.\">named<\/a> Stitt\u2019s chief of staff. A search for his replacement is ongoing, said Kate Vesper, a spokeswoman for Stitt.<\/p>\n\n\n\n<p>Two positions have sat empty since September 2021, when board members resigned amid scrutiny that each had ties to Epic Charter Schools. Treat and McCall each are <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=468089\">responsible<\/a> for one of those appointments.<\/p>\n\n\n\n<p><em>Oklahoma Watch<\/em> attempted to contact McCall and Treat through their press offices; neither responded with a comment.\u00a0<\/p>\n\n\n\n<iframe title=\"Vacancies on the Statewide Virtual Charter School Board\" aria-label=\"Map\" id=\"datawrapper-chart-2Ka2Z\" src=\"https:\/\/datawrapper.dwcdn.net\/2Ka2Z\/2\/\" scrolling=\"no\" frameborder=\"0\" style=\"width: 0; min-width: 100% !important; border: none;\" height=\"454\" data-external=\"1\"><\/iframe><script type=\"text\/javascript\">!function(){\"use strict\";window.addEventListener(\"message\",(function(e){if(void 0!==e.data[\"datawrapper-height\"]){var t=document.querySelectorAll(\"iframe\");for(var a in e.data[\"datawrapper-height\"])for(var r=0;r<t.length;r++){if(t[r].contentWindow===e.source)t[r].style.height=e.data[\"datawrapper-height\"][a]+\"px\"}}}))}();\n<\/script>\n\n\n\n<p>Operating with the minimum of three board members for over a year has meant if one person was late, or couldn\u2019t attend a meeting, the Statewide Virtual Charter School Board could not conduct business. All action items had to be approved unanimously.\u00a0<\/p>\n\n\n\n<p>\u201cIt was pretty onerous to manage,\u201d Franklin said.&nbsp;<\/p>\n\n\n\n<p>In the meantime, the board has overseen critical reforms at Epic Charter Schools, moving <a href=\"https:\/\/oklahomawatch.org\/2020\/10\/13\/state-virtual-board-vote-puts-epic-charter-schools-in-jeopardy\/\">to terminate <\/a>Epic\u2019s contract in 2020 after an investigative audit showed the school violated state law and mismanaged public dollars. Ultimately, the school <a href=\"https:\/\/oklahomawatch.org\/2021\/04\/22\/settlement-gives-epic-charter-schools-fresh-start-on-shrouded-learning-fund\/\">settled with the board <\/a>and avoided closure.<\/p>\n\n\n\n<p>Epic has an outsized impact on the state\u2019s education budget. With nearly 28,500 students this year, it is the state\u2019s third largest district behind Tulsa and Oklahoma City, yet takes a larger portion of the state budget because it doesn\u2019t receive local tax dollars.&nbsp;<\/p>\n\n\n\n<p>The Statewide Virtual Charter School Board is the only entity that legally can authorize statewide virtual charter schools. It oversees Epic and six other virtual charter schools, including <a href=\"https:\/\/oklahomawatch.org\/newsletter\/education-watch-state-to-consider-adding-two-more-virtual-charter-schools\/\">Virtual Preparatory Academy<\/a>, which is expected to begin this fall.&nbsp;<\/p>\n\n\n\n<p>The Legislature previously has proposed changing that authority. A 2022 <a href=\"http:\/\/www.oklegislature.gov\/BillInfo.aspx?Bill=HB3545&amp;Session=2200\">bill<\/a> by Rep. Chad Caldwell, R-Enid, would have created a new 15-member board to authorize all charter schools.&nbsp;<\/p>\n\n\n\n<p>In 2021, Rep. Rhonda Baker, R-Yukon, <a href=\"http:\/\/www.oklegislature.gov\/BillInfo.aspx?Bill=HB2753&amp;Session=2100\">proposed<\/a> eliminating the Statewide Virtual Charter School Board and folding its duties into the Office of Educational Quality and Accountability.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Both measures failed, and no similar proposals have been filed for the upcoming session. The filing deadline is Jan. 19.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Catholic School Proposal Will Push Legal Boundaries<\/strong><\/h2>\n\n\n\n<p>The Statewide Virtual Charter School Board\u2019s deadline for new school applications is Jan. 31, and it expects a proposal from the Archdiocese of Oklahoma City. Executive Director Rebecca Wilkinson was notified by Archbishop Paul Coakley that the Archdiocese planned to apply for a virtual charter school.&nbsp;<\/p>\n\n\n\n<p>In his seven-page letter, Coakley argues that prohibiting the Archdiocese from establishing a virtual charter school solely because of its religion would violate the First Amendment.&nbsp;<\/p>\n\n\n\n<p>\u201cThe Archdiocese is enthusiastic about sponsoring a virtual charter school to improve educational opportunities for children and families in the state,\u201d he wrote. \u201cYet we cannot ignore the reality that, regrettably, the discriminatory and unlawful exclusion of religious schools remains at least formally on the books of the state\u2019s Charter School Act.\u201d<\/p>\n\n\n\n<iframe loading=\"lazy\"\n  src=\"https:\/\/embed.documentcloud.org\/documents\/23572234-archdiocese-letter-to-svcsb\/?embed=1&amp;responsive=1&amp;title=1\"\n  title=\"Archdiocese letter to SVCSB (Hosted by DocumentCloud)\"\n  width=\"700\"\n  height=\"907\"\n  style=\"border: 1px solid #aaa; width: 100%; height: 800px; height: calc(100vh - 100px);\"\n  sandbox=\"allow-scripts allow-same-origin allow-popups allow-forms allow-popups-to-escape-sandbox\"\n><\/iframe>\n\n\n\n\n<p>The<a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=104637\"> Charter School Act<\/a> requires a school to be nonsectarian in its programs, admissions policies, employment practices and all other operations. The law also prohibits charter schools from being affiliated with private, religious schools or religious institutions.&nbsp;<\/p>\n\n\n\n<p>Wilkinson requested an attorney general\u2019s opinion to help the agency navigate the issue. The <a href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocu\">opinion<\/a>, issued Dec. 1 by unelected, lame duck Attorney General John O\u2019Connor, advised the Statewide Virtual Charter School Board to disregard the state and federal bans on religious charter schools in light of recent U.S. Supreme Court decisions.&nbsp;<\/p>\n\n\n\n<p>The opinion was the last of seven issued in 2022, despite a <a href=\"https:\/\/nondoc.com\/2023\/01\/06\/key-questions-as-gentner-drummond-becomes-attorney-general\/\">backlog<\/a> of at least 40 requests. Gentner Drummond, sworn in last week as state attorney general, defeated O\u2019Connor in the GOP primary by about 6,000 votes.<\/p>\n\n\n\n<p>The board has more than O\u2019Connor\u2019s opinion to consider. In December, the group Freedom From Religion Foundation opposed O\u2019Connor\u2019s opinion in a <a href=\"https:\/\/ffrf.org\/uploads\/legal\/StatewideVirtualCharterSchoolBoardOK.pdf\">10-page letter <\/a>to the board.
